Canopy Kings – Terms and Conditions
1. Introduction
These Terms and Conditions ("Terms") govern the provision of tree surgery services by Canopy Kings ("the Company"), including all related services such as tree felling, pruning, stump removal, hedge trimming, and arboricultural surveys. By engaging the Company’s services, the customer agrees to these Terms, which comply with UK law.
2. Quotations and Acceptance
2.1. All quotes provided by the Company are free of charge and valid for 30 days unless otherwise stated. 2.2. Quotes are based on the information provided by the customer. If additional work is required due to unforeseen circumstances (e.g., hidden obstructions or conditions), the Company reserves the right to adjust the quote accordingly. 2.3. Acceptance of a quote and commencement of work constitutes agreement to these Terms.
3. Cancellation Policy
3.1. Customers may cancel their scheduled services without charge if notice is given at least 48 hours prior to the agreed start date. 3.2. If less than 48 hours’ notice is provided, the Company reserves the right to charge up to 50% of the quoted amount to cover any costs incurred. 3.3. The Company reserves the right to postpone or cancel services due to adverse weather conditions, safety concerns, or any other unforeseeable circumstances.
4. Work Standards and Safety
4.1. All work will be carried out by fully qualified and insured tree surgeons in compliance with health and safety standards. 4.2. The customer is responsible for notifying the Company of any specific hazards (e.g., power lines, underground utilities) that could impact the safety of the work. Failure to inform the Company may result in additional charges or delays. 4.3. The Company will take all necessary precautions to minimise any risk or damage during the work. However, the customer is responsible for securing all necessary permissions, including any required permits or consent from the local council for tree preservation orders (TPOs).
5. Tree Preservation Orders (TPOs) and Conservation Areas
5.1. It is the customer’s responsibility to inform the Company if any trees are subject to Tree Preservation Orders or are located in a Conservation Area. The Company will assist in applying for permission, but any legal responsibility remains with the customer. 5.2. The Company will not be held liable for any fines or legal action resulting from work carried out on protected trees without the necessary approvals.
6. Waste Disposal
6.1. All waste generated during the work, including tree branches, stumps, and other debris, will be removed by the Company unless otherwise specified in the quote. 6.2. Should the customer wish to retain any wood, branches, or wood chips, this must be agreed upon before work begins.
7. Payment Terms
7.1. Payment is due upon completion of the work unless otherwise agreed in writing. 7.2. For larger projects or commercial contracts, a deposit may be required before work commences, with the balance due upon completion. 7.3. Invoices not paid within 30 days may incur interest at a rate of 8% above the Bank of England base rate, in line with the Late Payment of Commercial Debts Act 1998.
8. Liability and Insurance
8.1. The Company carries public liability insurance up to £5 million, covering any damage or injury caused during the course of our work. Proof of insurance can be provided upon request. 8.2. The Company will not be held liable for damage to underground utilities, such as water pipes, gas pipes, or electric cables, unless their location has been clearly marked by the customer. 8.3. The Company’s liability is limited to direct damage to property or injury and does not cover any indirect, consequential, or financial loss.
9. Delays and Force Majeure
9.1. The Company will make every effort to complete the agreed services within the specified timeframe. However, the Company is not liable for delays caused by factors beyond its control, such as weather, illness, or unavailability of materials. 9.2. In the event of a force majeure (e.g., extreme weather, natural disaster), the Company reserves the right to suspend or cancel the contract without liability.
10. Guarantees and Warranties
10.1. The Company guarantees that all work will be carried out to a professional standard in line with industry best practices. 10.2. No guarantees are made regarding the future health of trees following pruning or felling, as these factors are often outside the control of the Company. Development
11. Customer Responsibilities
11.1. The customer is responsible for providing access to the property and ensuring the site is ready for the work to begin. This includes clearing any obstacles and securing pets or livestock. 11.2. If the customer fails to provide access or does not prepare the site, the Company reserves the right to charge for any additional time spent waiting or preparing the site.
12. Complaints and Dispute Resolution
12.1. If the customer is not satisfied with the work carried out, they must notify the Company within 7 days of completion. The Company will make every effort to resolve the issue. 12.2. Any disputes that cannot be resolved through mutual agreement will be subject to UK law and the jurisdiction of the courts in England and Wales.
13. Governing Law
These Terms and Conditions are governed by and construed in accordance with the laws of England and Wales.
